General terms and conditions

  1. Our invoices are payable without discount 30 days from invoice date. Invoices are delivered by mail or regular mail. If the customer wishes this to be done in another way (e.g. own software), an administrative fee of 20,00€ per invoice will be charged. Per training session, we make one invoice. If the client wishes an invoice for a session to be split into several invoices (e.g. to different companies), an administrative fee of 50,00€ will be charged.
  2. In the event of non-payment of an invoice on the due date, Formaz BVBA may suspend performance. Any amount unpaid on the due date will, without prior notice and by right, be increased with a conventional interest equal to the interest rate as stipulated in art 5 of the Late Payment Act +3% and which will be a minimum of 12% and a fixed compensation for the recovery costs, excluding judicial recovery costs, of 10% and which will be a minimum of 50 EUR per invoice.
  3. If the customer requires references on the invoice, such as purchase order numbers, these should be included with the order. with the order. A lack thereof can never be a reason for non-payment.
  4. The client is responsible for providing the proper infrastructure and work equipment and personnel at the time of service provision. A lack of this with the possible consequence of not or only partially performing the services can never be a reason for non-payment.
  5. Certificates, certificates of participation and attestations for paid educational leave, etc. will be delivered or published after payment of the invoice.
  6. In the event of cancellation or rescheduling of the agreement by the customer, the following conditions shall apply:
    • Cancellation/relocation more than 4 weeks prior to the start of services will incur 25% of the quotation price as a cancellation fee.
    • For cancellation/move less than 4 weeks and more than 2 weeks before the start of services, 50% of the offer price is due as cancellation fee.
    • For cancellation/move less than 2 weeks and more than 1 week before the start of services, 75% of the offer price is due as cancellation fee.
    • In case of cancellation/relocation of the agreement by the client at less than 1 week before the start of services, 100% of the offer price is due as cancellation fee.
    • Cancellation/rescheduling must be done by email or letter. Cancellation or rescheduling of trainings because of corona are only free of charge if the training in question may not take place or continue due to governmental reasons.
  7. If subsidies are used, the standard procedures of the various subsidy bodies (deadlines and procedures for the SME portfolio, applications to sector funds, etc.) must be followed. Subsequent rectifications are not possible. Subsidy applications are always made on the client's initiative.
  8. In case of disputes, the courts of Brussels shall have exclusive jurisdiction.
